Terms of Use

Effective date: January 1, 2026

These Terms of Use ("Terms") set out the conditions for use of the dispatch and booking arrangement service ("Service") provided by HANA TAXI & TOUR INC ("we," "our," or "us"). By using the Service, you ("Customer") are deemed to have agreed to these Terms.

1. Nature and Role of the Service

At your request, we provide a matching service that requests and arranges dispatch with independent drivers (including sole proprietors).

We are not a transportation carrier. The contract of carriage and the passenger transportation service itself are formed between you and the driver who actually provides the transportation.

2. Reservation and Cancellation

Reservation confirmation: A reservation is confirmed once you submit a request by phone, website, or messaging app (e.g., LINE) and we send a confirmation notice.

Cancellation fee (free of charge): Reflecting our origins as a call-taxi business, we do not charge any fee for advance cancellations, so you can book with ease.

Cancellation notice: If you need to change or cancel your reservation, please contact us promptly by phone or LINE.

3. Fees and Payment

Fares and payment terms follow the fixed rate, flat rate, or metered rate provided at the time of booking.

Payment may be made by credit card, cash, or any other method we designate.

4. Limitation of Liability

Delays: We are not liable for delays, or damages resulting from delays (such as missed flights), caused by matters beyond our reasonable control, including traffic congestion, road construction, adverse weather, vehicle malfunction, or flight delays. Please book with sufficient time to spare.

Loading, unloading, and damage to luggage:

• Assistance from the driver in loading or unloading luggage (e.g., into the trunk) is provided as a courtesy and incidental part of the service.
• Neither we nor the driver is liable for unintended scuffing, impact, dents, or damage to suitcases or their contents that may occur during this assistance.
• If you are concerned about damage to high-value items, precision equipment, glassware, or other fragile luggage, please load and unload such items yourself.
• We will assist in searching for items left in the vehicle, but any storage or return-shipping costs are the customer's responsibility.

Accidents: In the event of a traffic accident, liability for damages is handled within the scope of the commercial auto insurance carried by the driver operating the vehicle. We do not assume direct transportation liability beyond our role as an intermediary arranging the service.

5. Prohibited Conduct and Refusal of Service

We or the driver may refuse or immediately discontinue service if you engage in any of the following:

• Drinking alcohol or smoking (including e-cigarettes) in the vehicle, which is prohibited under Hawaii state law
• Violence, verbal abuse, harassment, or other disruptive behavior toward the driver or other customers
• Significantly soiling the vehicle

If special cleaning of the vehicle becomes necessary due to your conduct (e.g., vomiting or soiling caused by intoxication), we or the driver may charge a cleaning or repair fee (approximately $150–$300).

6. Handling of Personal Information

Personal information we collect from you is managed appropriately in accordance with our Privacy Policy and is used solely for dispatch, communication, and service-provision purposes.

7. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Hawaii.

Any dispute arising in connection with the Service shall be subject to the exclusive jurisdiction of the courts located in Honolulu, State of Hawaii, as the court of first instance.
